These Terms of Service govern your access to and use of the LOST ERA website, online store, content, products and related services. By accessing the website or placing an order, you agree to these terms and the policies incorporated by reference, including our Privacy Policy, Shipping & Delivery Policy and Return & Refund Policy.

This store is operated by LOST ERA from New South Wales, Australia and is hosted on Shopify. References to “we”, “us” and “our” mean LOST ERA. References to “you” mean the visitor, customer or account holder.

Eligibility and accounts

You must be legally capable of entering a binding contract in your jurisdiction, or use the store with the permission and supervision of a parent or guardian. You are responsible for accurate information and for protecting account credentials.

Products and information

We aim to present product descriptions, measurements, colours and images accurately. Screens, lighting, production batches and manual measurement can cause minor variations. Size charts describe garment measurements unless stated otherwise. Nothing in these terms limits consumer guarantees or remedies that cannot lawfully be excluded.

Prices, taxes and promotions

Prices are shown in the currency displayed by the store and may change before an order is accepted. Taxes, delivery charges and other amounts we collect are shown at checkout. Your bank may charge conversion or transaction fees. Discounts may be subject to time, quantity, product, destination or eligibility restrictions and cannot be combined unless stated.

We may correct an obvious pricing or promotional error before dispatch. If you do not accept a corrected price, you may cancel for a full refund.

Orders and acceptance

An order confirmation means we received your order; it does not necessarily mean final acceptance. We may refuse or cancel an order before dispatch because of suspected fraud, payment failure, stock unavailability, an obvious error, delivery restrictions or a breach of these terms. If payment was taken, we will refund the affected amount.

Payment

You authorise us and our payment providers to charge the amount shown at checkout and confirm that you may use the selected payment method. Payment information is handled securely by payment providers under their applicable terms and privacy practices.

Delivery

Processing, tracking, delivery estimates, customs charges and address requirements are governed by our Shipping & Delivery Policy. Delivery dates are estimates unless expressly guaranteed.

Cancellations, returns and refunds

Cancellations, change-of-mind returns, faulty goods and refunds are governed by our Return & Refund Policy. Nothing in these terms excludes rights under the Australian Consumer Law or other mandatory consumer laws.

Reviews and other content

If you submit a review, image, comment or other content, you confirm it is lawful, accurate and does not infringe another person's rights. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for store and marketing purposes, subject to applicable privacy law. We may remove content that is unlawful, misleading, abusive, irrelevant or otherwise violates these terms.

Intellectual property

The website's branding, layout, text, graphics and original content are owned by or licensed to LOST ERA. You may use the website for personal shopping only. You must not copy, scrape, sell, modify or commercially exploit our content without written permission, except where the law permits.

Prohibited use

You must not use the website to commit fraud or unlawful conduct, introduce malware, interfere with security, collect other users' information without authority, impersonate another person, infringe intellectual-property or privacy rights, submit false information or attempt unauthorised access.

The store may use or link to external services that support website operation, payment and delivery. We are not responsible for an independent website's content or conduct, but this does not limit any responsibility we cannot lawfully exclude for services arranged as part of your purchase.

Availability and changes

We may update, suspend or discontinue website features for maintenance, security, operational or legal reasons. We do not promise uninterrupted or error-free website access.

Liability

Nothing in these terms excludes or limits liability for fraud, wilful misconduct, Australian Consumer Law guarantees or any liability that cannot legally be excluded. Subject to those rights, we are not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed.

Termination

We may suspend access where reasonably necessary to protect the store, customers or other people, or where you materially breach these terms.

Governing law

These terms are governed by the laws of New South Wales, Australia, subject to any mandatory rights you have under the laws of your location.

Severability

If a provision is invalid or unenforceable, it will be read down or removed to the minimum extent necessary, and the remaining terms continue.

Changes to these terms

We may update these terms by posting a revised version. Changes apply prospectively from the stated date. The terms in effect when your order was placed continue to govern that order unless the law requires otherwise.
